Asliye Hukuk Mahkemesi&#8217;nce davan\u0131n kabul\u00fcne dair verilen 7.12.2010 g\u00fcn ve 2009\/126 E-2010\/463 K. say\u0131l\u0131 karar\u0131n incelenmesi davac\u0131 Belediye vekili taraf\u0131ndan istenilmesi \u00fczerine, Yarg\u0131tay 18. Hukuk Dairesi&#8217;nin 24.11.2011 g\u00fcn ve 2011\/9673 E-2011\/10536 K. say\u0131l\u0131 ilam\u0131 ile;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">( &#8230; Mahkemece yap\u0131lan ara\u015ft\u0131rma ve incelemeyle al\u0131nan bilirki\u015fi raporu h\u00fck\u00fcm kurmaya yeterli de\u011fildir. \u015e\u00f6yle ki,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kamula\u015ft\u0131rma Yasas\u0131&#8217;n\u0131n 10. maddesiyle bedelin tespiti esaslar\u0131n\u0131 d\u00fczenleyen 11. maddenin ( g ) bendi h\u00fckm\u00fcne g\u00f6re;&nbsp;<strong>kamula\u015ft\u0131r\u0131lacak ta\u015f\u0131nmaz<\/strong>\u0131n arsa olarak kabul\u00fc halinde kamula\u015ft\u0131rma ( de\u011ferlendirme ) g\u00fcn\u00fcnden \u00f6nceki \u00f6zel amac\u0131 olmayan emsallerin sat\u0131\u015f de\u011feri esas al\u0131narak de\u011ferinin tespit edilmesi gerekir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Bu esaslara g\u00f6re ger\u00e7ek\u00e7i ve do\u011fru sonu\u00e7lara ula\u015f\u0131labilmesi i\u00e7in ana ama\u00e7; emsal al\u0131nan ta\u015f\u0131nmaz\u0131n sat\u0131\u015f tarihinin de\u011ferlendirme tarihinden \u00f6nce ve de\u011ferlendirme tarihine yak\u0131n bulunmas\u0131, davaya konu ta\u015f\u0131nmaza \u00f6rnek te\u015fkil edebilecek nitelikte, davaya konu ta\u015f\u0131nmazla ayn\u0131 veya yak\u0131n semtlerde bulunmas\u0131, topografik yap\u0131s\u0131, manzaras\u0131, konumu, \u00fczerinde yap\u0131labilecek in\u015faat ve katlar i\u00e7in izin ve ruhsat s\u0131n\u0131rlar\u0131, y\u00fcz\u00f6l\u00e7\u00fcmleri, imar uygulamas\u0131na konu edilmi\u015f olup olmad\u0131klar\u0131, sokak, cadde veya \u015fehir alanlar\u0131na cepheleri ve mesafeleri gibi y\u00f6nlerden benzer ya da yak\u0131n \u00f6zelliklere sahip bulunmas\u0131 gereklidir. \u0130zmir gibi b\u00fcy\u00fck \u015fehirlerde yukarda a\u00e7\u0131klanan bu \u00f6zellikler itibar\u0131yla davaya konu ta\u015f\u0131nmaza daha yak\u0131n konumda ve de\u011ferlendirme tarihine yak\u0131n sat\u0131\u015f tarihli ta\u015f\u0131nmaz sat\u0131\u015flar\u0131n\u0131n bulunmas\u0131 m\u00fcmk\u00fcn oldu\u011fu halde h\u00fckme esas al\u0131nan bilirki\u015fi raporunda davaya konu ta\u015f\u0131nmazla yukarda a\u00e7\u0131klanan \u00f6zellikler itibar\u0131yla benzer \u00f6zellikler ta\u015f\u0131mayan ve sat\u0131\u015f tarihinin 1993 olmas\u0131 sebebiyle aradan ge\u00e7en uzun s\u00fcrenin yan\u0131lt\u0131c\u0131 sonu\u00e7lara g\u00f6t\u00fcrebilece\u011fi de dikkate al\u0131nmadan 1242 ada 24 parselin sat\u0131\u015f\u0131n\u0131n somut emsal al\u0131nm\u0131\u015f olmas\u0131 do\u011fru g\u00f6r\u00fclmemi\u015ftir.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Mahkemece taraflar\u0131n verece\u011fi ya da re&#8217;sen getirtilecek kay\u0131tlar \u00fczerinden yukarda a\u00e7\u0131klanan ilkelere uygun ta\u015f\u0131nmaz sat\u0131\u015flar\u0131 ara\u015ft\u0131r\u0131larak emsal olabilme niteliklerine uygun bulunanlar tespit edilip bu emsallerin 11. maddenin ( d ) bendinde \u00f6ng\u00f6r\u00fclen vergiye esas olmak \u00fczere ilgili belediyelerce bulunduklar\u0131 cadde veya sokak i\u00e7in de\u011ferlendirme tarihindeki asgari m2 de\u011ferleri getirtilip, davaya konu ta\u015f\u0131nmaz\u0131n de\u011ferlendirme, emsal ta\u015f\u0131nmazlar\u0131n ise de\u011ferlendirmeye esas al\u0131nan sat\u0131\u015f tarihleri itibar\u0131yla imar d\u00fczenlemesi sonucu meydana gelen imar parsellen olup olmad\u0131klar\u0131 da belediye imar m\u00fcd\u00fcrl\u00fc\u011f\u00fc ve tapu m\u00fcd\u00fcrl\u00fcklerinden ara\u015ft\u0131r\u0131l\u0131p bu emsallere g\u00f6re ve ayr\u0131nt\u0131l\u0131 olarak kar\u015f\u0131la\u015ft\u0131rma yapan raporlar al\u0131narak olu\u015facak duruma g\u00f6re karar verilmelidir.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu itibarla yukarda a\u00e7\u0131klanan esaslar g\u00f6z\u00f6n\u00fcnde tutulmaks\u0131z\u0131n yaz\u0131l\u0131 \u015fekilde h\u00fck\u00fcm tesisi isabetsizdir&#8230; ),<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gerek\u00e7esiyle bozularak dosya yerine geri \u00e7evrilmekle yeniden yap\u0131lan yarg\u0131lama sonunda; mahkemece \u00f6nceki kararda direnilmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">H.G.K.&#8217;nca incelenerek direnme karar\u0131n\u0131n s\u00fcresinde temyiz edildi\u011fi anlat\u0131ld\u0131ktan ve dosyadaki ka\u011f\u0131tlar okunduktan sonra gere\u011fi g\u00f6r\u00fc\u015f\u00fcld\u00fc:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">KARAR : Dava, 4650 Say\u0131l\u0131 Kanun&#8217;la de\u011fi\u015fik 2942 Say\u0131l\u0131 Kamula\u015ft\u0131rma Kanunu&#8217;nun 10. maddesine dayanan kamula\u015ft\u0131rma bedelinin tespiti ve kamula\u015ft\u0131r\u0131lan ta\u015f\u0131nmaz\u0131n davac\u0131 idare ad\u0131na tescili istemine ili\u015fkindir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Davac\u0131 vekili, afete maruz b\u00f6lgede kalmas\u0131 sebebiyle kamula\u015ft\u0131rma karar\u0131 verilen 12005 ada 7 parsel say\u0131l\u0131 ta\u015f\u0131nmaz\u0131n malikleri olan daval\u0131lar\u0131n uzla\u015fmaya davet edilmelerine ra\u011fmen anla\u015famad\u0131klar\u0131n\u0131, bu hususun anla\u015fmazl\u0131k tutana\u011f\u0131 d\u00fczenlenerek belirlendi\u011fini ileri s\u00fcrerek, kamula\u015ft\u0131rma bedelinin tespitiyle ta\u015f\u0131nmaz\u0131n davac\u0131 Belediye ad\u0131na tescilini istemi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Daval\u0131lardan bir k\u0131sm\u0131 davan\u0131n reddini savunmu\u015ftur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mahkemece, Sultaniye Mahallesi 1242 ada 24 parsel say\u0131l\u0131 ta\u015f\u0131nmaz\u0131 emsal alan bilirki\u015fi raporu do\u011frultusunda kamula\u015ft\u0131rma bedeli belirlenerek, davan\u0131n kabul\u00fcne karar verilmi\u015ftir. Davac\u0131 vekilinin temyizi \u00fczerine h\u00fck\u00fcm, \u00d6zel Dairece yukar\u0131ya metni aynen alman ilamla bozulmu\u015ftur. yerel mahkemece \u00f6nceki gerek\u00e7eyle direnilmi\u015ftir. Direnme karar\u0131n\u0131 temyize davac\u0131 vekili getirmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">H.G.K. \u00f6n\u00fcne gelen uyu\u015fmazl\u0131k;&nbsp;<strong>Kamula\u015ft\u0131rma bedeli<\/strong>nin belirlenmesinde; mahkemece 24 numaral\u0131 parseli emsal kabul eden bilirki\u015fi raporuna g\u00f6re h\u00fck\u00fcm kurulmas\u0131n\u0131n isabetli olup olmad\u0131\u011f\u0131, buna g\u00f6re, bozma ilam\u0131nda de\u011finilen \u015fekilde yeniden emsal ara\u015ft\u0131rmas\u0131 yap\u0131lmas\u0131 gerekip gerekmedi\u011fi noktas\u0131nda toplanmaktad\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dosya i\u00e7eri\u011fi, toplanan delillere g\u00f6re ve \u00f6zellikle \u00d6zel Daire bozma ilam\u0131nda belirtilen gerek\u00e7elerle bozma ilam\u0131na uyulmak gerekirken, \u00f6nceki kararda direnilmesi usul ve yasaya ayk\u0131r\u0131d\u0131r. Bu sebeple direnme karar\u0131 bozulmal\u0131d\u0131r. ( Nitekim Yarg\u0131tay H.G.K.&#8217;nun 26.6.2013 g\u00fcn, 2013\/18-32 E., 2013\/885 K. say\u0131l\u0131 ilam\u0131n\u0131n da ayn\u0131 y\u00f6nde oldu\u011fu g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. )<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">SONU\u00c7 : Davac\u0131 vekilinin temyiz itirazlar\u0131n\u0131n kabul\u00fc ile, direnme karar\u0131n\u0131n \u00d6zel Daire bozma ilam\u0131nda g\u00f6sterilen nedenlerden dolay\u0131 6217 Say\u0131l\u0131 Kanunun 30. maddesiyle 6100 Say\u0131l\u0131 Hukuk Muhakemeleri Kanunu&#8217;na eklenen &#8220;Ge\u00e7ici madde 3&#8221; atf\u0131yla uygulanmakta olan 1086 Say\u0131l\u0131 Hukuk Usul\u00fc Muhakemeleri Kanunu&#8217;nun 429. maddesi gere\u011fince BOZULMASINA, istenmesi halinde temyiz pe\u015fin harc\u0131n\u0131n yat\u0131rana iadesine, ayn\u0131 kanunun 440. maddesi uyar\u0131nca h\u00fckm\u00fcn tebli\u011finden itibaren 15 g\u00fcn i\u00e7erisinde karar d\u00fczeltme yolu a\u00e7\u0131k olmak \u00fczere, 19.03.2014 tarihinde oybirli\u011fiyle karar verildi.<\/p>","protected":false},"excerpt":{"rendered":"<p>T.C.
